Welcome to KompanionAI ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at [kompanionai.store](https://kompanionai.store), our AI companion services including Kompanion Echo (KAI), and any related offerings (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

We may update these Terms. Changes will be posted here with the effective date. Continued use after changes constitutes acceptance.

1. Description of Services

KompanionAI provides AI companions designed to combat loneliness through persistent memory and emotional support. KAI remembers your stories, preferences, and progress across devices (e.g., phones, computers, smart speakers). Features include conversation continuity, image generation, email sending, code writing, and task management. Upcoming variants: KAI Kids (educational for children), KAI Golden Years (for seniors), and KAI Couture (customized).

Services are provided "as is" and may evolve. Access may require an account or custom order.

2. Eligibility and Accounts

You must be at least 13 years old (or 16 in some regions) and capable of forming a binding contract to use the Services. For KAI Kids, users must be under parental supervision.

3. User Content and Conduct

User Content

You retain ownership of content you share with KAI (e.g., conversations, prompts, uploads; "User Content"). By sharing, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process it to provide and improve the Services (e.g., training AI models with anonymized data).

Prohibited Conduct

You agree not to:

- Use Services for illegal, harmful, or abusive purposes (e.g., harassment, spam).

- Violate intellectual property rights or privacy.

- Attempt to hack, disrupt, or reverse-engineer the Services.

- Share false information or impersonate others.

- Use for professional therapy (KAI is not a substitute for medical advice).

We may monitor usage for compliance and remove violating content.

4. Intellectual Property

We own all rights to the Services, including AI models, software, and generated outputs (except your User Content). You may not copy, modify, or distribute without permission. Trademarks like "KompanionAI" and "KAI" are ours.

5. Fees and Payments

Currently, core Services are free, but custom orders or future subscriptions may incur fees. Payments are processed via third-party providers. Refunds are at our discretion. All fees are non-refundable except as required by law.

6. Disclaimers

The Services are for companionship and general support, not medical, legal, or professional advice. AI responses may contain errors or biases. Use at your own risk. We do not guarantee uninterrupted access, accuracy, or suitability for any purpose.

KAI's persistent memory is designed for emotional growth but may not perfectly replicate human relationships.

7. Limitation of Liability

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages, including loss of data or profits, arising from your use of the Services. Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

8. Indemnification

You agree to indemnify and hold us harmless from claims arising from your violation of these Terms or misuse of User Content.

9. Termination

We may suspend or terminate your access for violation of these Terms, with or without notice. Upon termination, your right to use the Services ends, and we may delete your data (subject to our Privacy Policy).

You may stop using the Services anytime. Sections surviving termination include IP rights, disclaimers, liability, and indemnification.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts in Hamilton County, Ohio.

11. Miscellaneous

These Terms are the entire agreement. If any provision is invalid, the rest remain enforceable. No waiver of any breach. We are not liable for failures due to events beyond our control (e.g., natural disasters).
